Moore and Smith, both arrested in October, were the 12th and 13th people charged with drug-induced homicide in Kane County, under a state law created in 1989 and expanded in 2002.
When Gregoire overdosed, Smith and her son were there, Kane County Sheriff’s spokesman Lt. Patrick Gengler said.
Smith is next to appear at 9 a.m. Friday, March 3, before judge James C. Hallock in Courtroom 313 at the Kane County Judicial Center.
Smith’s other previous convictions in Kane County include a 2014 retail theft for which she was sentenced to public service and probation.

The indictments charge each alleged member of the drug trafficking organization with conspiracy to distribute crack cocaine and associated crimes in 134-related counts.
Members of the organization also used intimidation, threats and violence to protect their business and rip off rival drug dealers, prosecutors said.
The U.S. Drug Enforcement Administration and Philadelphia Police were also involved in the investigation.
“For years, this organization has maintained a stranglehold on the Blumberg Apartments complex and surrounding neighborhoods,” FBI Special Agent in Charge Michael Harpster said in a statement.
Running the criminal enterprise like a professional business, the group’s leaders allegedly maintained a staff of drug pushers, police lookouts and bodyguards who worked in shifts, levied taxes on other distributors and protected members of the organization from attacks by rival drug trafficking groups.
